Terms of Service

Privacy PolicyTerms of Service

These Terms of Service ("Terms") govern access to and use of the PizzaPOS website, early-access program, point of sale, online ordering, payments, kitchen printing and display software, restaurant websites, dashboards, messaging services, and related software and devices provided by Pizza Phone AI Inc. ("PizzaPOS," "we," "us," or "our").

By using PizzaPOS, you agree to these Terms. If you use PizzaPOS for a restaurant, you confirm that you have authority to act for that restaurant.

1.The Service

PizzaPOS provides software and related services for pizzerias and restaurant groups that may include:

  • Point of sale software for taking and managing orders.
  • Online ordering and restaurant websites.
  • Payment processing through third-party payment-processing partners.
  • Kitchen ticket printing and optional kitchen display screens.
  • Oven, prep, and order-status tracking.
  • Restaurant dashboards, menu management, reporting, and analytics.
  • Requested transactional SMS messages after valid consent.
  • Connections with our sister service, PizzaPhone.ai.

PizzaPOS is a technology service. Restaurants remain responsible for their menus, prices, taxes, hours, food preparation, order acceptance, fulfillment, refunds, and customer-service decisions.

2.Early Access Program

PizzaPOS is being built with a group of early-access restaurants. During early access:

  • Features may be incomplete, may change, or may be added or removed as the product develops.
  • Some features described on our website, including the ability for PizzaPhone.ai to place orders directly in PizzaPOS, are planned and may not yet be available.
  • We may ask for feedback, and we may use the feedback you give us to improve PizzaPOS without any obligation to you.
  • Applying does not guarantee acceptance, and acceptance does not guarantee a launch date.

Pricing, devices, and other terms for early-access restaurants are set out in a separate order form or agreement.

3.Restaurant Responsibilities

Restaurants must provide accurate menus, prices, tax settings, hours, locations, policies, and contact information, and must promptly correct anything that is inaccurate or out of date.

Restaurants are responsible for complying with the laws and industry rules that apply to their business, including food service, sales tax, consumer protection, privacy, customer communications, and marketing.

4.Payments

Payment processing is provided by third-party payment-processing partners. To accept card payments, a restaurant must be approved for and agree to a separate merchant agreement with the applicable partner. Processing rates, fees, payouts, chargebacks, and reserves are governed by that merchant agreement and your order form.

PizzaPOS does not store complete payment-card numbers. PizzaPOS is not a bank and does not hold restaurant funds.

5.Devices and Hardware

Tablets, printers, kitchen displays, card readers, and other devices may be purchased or provided under the terms of your order form. Restaurants are responsible for reasonable care of devices, a working internet connection, and the network and power setup at their location. Device warranties, returns, and replacements are described in your order form or the manufacturer's warranty.

6.Text Messages

PizzaPOS sends text messages only to people who have given consent. Early-access applicants who check the SMS consent box on our Apply for Early Access form agree to receive calls and texts about their application and the program. Restaurant customers who choose order notifications may receive transactional texts about their order, such as an order confirmation or a ready-for-pickup notice.

Consent is not required to apply, to place an order, or to make a purchase. Messages sent under transactional consent do not include marketing, promotional, or bulk broadcast messages.

STOP: Opt out

Reply STOP to any message to opt out of future messages from that program. After you opt out, we will not send further messages from that program unless you opt in again.

HELP: Support

Reply HELP for assistance or contact [email protected].

Message frequency varies. Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages.

7.Prohibited Uses

You may not:

  • Use PizzaPOS for unlawful, fraudulent, abusive, deceptive, or harmful activity.
  • Process payments for goods or services that are illegal or that our payment partners do not allow.
  • Send marketing or promotional messages through a transactional SMS consent flow.
  • Send messages to people without the required consent.
  • Use purchased, rented, scraped, or affiliate lead lists for messaging.
  • Interfere with, reverse engineer, or attempt to compromise the service.
  • Misrepresent PizzaPOS, a restaurant, an order, or a payment.
  • Upload content that infringes another person's rights.

8.Accounts and Security

Restaurants are responsible for keeping account information accurate, protecting logins and staff access, and all activity under their accounts. Notify us promptly of unauthorized access or a suspected security incident.

9.Third-Party Services and PizzaPhone.ai

PizzaPOS may connect with third-party payment, delivery, messaging, hardware, or software providers. Those providers may have their own terms and privacy policies, and PizzaPOS is not responsible for their services or the transactions they handle.

PizzaPhone.ai is a separate service from our sister brand. When a restaurant uses PizzaPhone.ai, its use is also governed by the PizzaPhone Terms of Service.

10.Fees and Subscriptions

Subscriptions, device costs, payment-processing rates, trials, billing periods, cancellation rules, and taxes are described at sign-up, in an order form, or in a separate agreement. Unless otherwise stated, subscription charges are non-refundable after the applicable billing period begins.

11.Your Data

Restaurants own their menus, customer lists, and order and sales data. You give PizzaPOS the rights reasonably needed to host, process, and use that data to provide, secure, support, and improve the service. If you stop using PizzaPOS, you may request an export of your data, subject to our retention obligations and the timing described in your agreement.

12.Intellectual Property

PizzaPOS and its licensors own the service, software, designs, trademarks, documentation, and related materials. These Terms grant only a limited, non-exclusive, non-transferable right to use the service during your subscription or permitted access period.

13.Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information.

14.Service Availability and Changes

We may modify, suspend, or discontinue any part of the service, temporarily or permanently, for maintenance, security, legal, business, or operational reasons. We do not guarantee uninterrupted or error-free service, including during internet, power, carrier, or payment-network outages.

15.Disclaimer

To the maximum extent permitted by law, PizzaPOS provides the service "as is" and "as available." We disclaim warranties not expressly stated in these Terms, including warranties of uninterrupted availability, accuracy, fitness for a particular purpose, and non-infringement.

16.Limitation of Liability

To the maximum extent permitted by law, PizzaPOS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost revenue, profits, data, orders, or goodwill arising from use of the service.

To the maximum extent permitted by law, PizzaPOS's total liability for claims relating to the service will not exceed the subscription fees paid to PizzaPOS during the three months before the event giving rise to the claim.

17.Indemnity

You agree to defend and indemnify PizzaPOS and its officers, directors, employees, and service providers against claims, losses, liabilities, and expenses arising from your unlawful use of the service, your content, your failure to obtain required consent, or your violation of these Terms.

18.Termination

We may suspend or terminate access if you violate these Terms, create risk, fail to pay applicable fees, or use the service unlawfully. You may stop using the service at any time, subject to your order form or agreement. Provisions that by their nature should survive termination will survive, including privacy, intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions.

19.Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law rules.

20.Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the service after an update means you accept the revised Terms.
